Terms of service

For restaurants subscribing to TableServe. Guests ordering at a table contract with the restaurant, not with us.

1. What is provided

the operator named in the imprint provides hosted software for QR-code menus, table ordering, a kitchen board, payment requests and reporting. The restaurant supplies its own menu content, prices, allergen and additive declarations, and is responsible for their accuracy.

2. Subscription, prices and invoicing

Basic runs for 30 days (€29) or 365 days (€290); Smart runs for 30 days (€59) or 365 days (€590); Pro runs for 30 days (€98) or 365 days (€980). Prices are business-to-business and quoted net; statutory VAT is added on the invoice. A term renews only when it is extended or renewed. Signing up for Smart on the monthly term gives the first 7 days at no charge; the remainder of that first period, and every period after it, is billed at the regular price unless cancelled first.

3. Cancellation

A subscription can be cancelled at any time from the Subscription page. Cancellation takes effect at the end of the term already paid for; access and data export remain available until then. Because this is a business-to-business service, the statutory consumer right of withdrawal does not apply.

4. The restaurant's obligations

The restaurant must keep its imprint, allergen information (Regulation (EU) 1169/2011) and prices accurate and up to date, apply the correct VAT rates, and comply with food hygiene and cash-register law in its country. Where German cash-register rules (KassenSichV) require a certified technical security device for cash takings, providing it remains the restaurant's responsibility — this software records orders and issues receipts but is not itself a certified TSE.

5. Data protection

The restaurant is the controller for guest order data and the operator named in the imprint acts as its processor under GDPR art. 28. Details are set out in the privacy policy.

6. Availability and liability

The service is provided with reasonable care but without a guarantee of uninterrupted availability. Liability is limited to intent and gross negligence, except where statutory liability — including for injury to life, body or health — cannot be limited.

7. Ending the agreement and your data

Order history and menu data can be exported at any time, including after cancellation. On request the account and its data are deleted, subject to statutory retention duties.

8. Governing law

The law of the operator's registered seat applies, without prejudice to mandatory provisions of the customer's own jurisdiction.
